As passed the Senate, S.B. 1295 classified, as a class 5 felony, the killing or cruel mistreatment of a domestic animal.
The House of Representatives adopted a strike everything amendment that does the following:
Purpose
Removes the prohibition on the ability of insurance producers to charge certain fees.
Background
Current law prohibits an insurance producer from charging or receiving any fee or service charge in addition to the premium, unless both of the following apply: 1) the fee or service charge and the specific services for which it is charged are disclosed and agreed to in writing by the insured; and 2) the amount of the fee or service charge is reasonably related to the cost of the service rendered and does not duplicate or increase any fee or service charge included in the insurer's rate filing.
Notwithstanding the above conditions, an insurance producer is prohibited from charging or receiving any fee or service charge in connection with the transaction of life, annuity, long-term care or Medicare supplement insurance (A.R.S. § 20-465).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Removes the prohibition on the ability of an insurance producer to be able to charge or receive a fee or service charge for life, annuity and long-term care insurance. Retains the prohibition on charging fees or service charges on Medicare supplement insurance.
2. Becomes effective on the general effective date.
