Purpose
Increases the allowable size and weight for a vehicle classified as an all-terrain vehicle that is also a recreational off-highway vehicle.
Background
An all-terrain vehicle that is also classified as a recreational off-highway vehicle must satisfy the following requirements: 1) be designed for all-terrain, nonhighway travel; 2) be 65 inches or less in width; 3) have an unladen weight of 1,800 pounds or less; and 4) travel on four or more nonhighway tires (A.R.S. § 28-101).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Increases, from 65 inches to 80 inches, the maximum width for a vehicle to be classified as an all-terrain vehicle that is also a recreational off-highway vehicle.
2. Increases, from 1,800 pounds to 2,500 pounds, the maximum unladen weight for a vehicle to be classified as an all-terrain vehicle that is also a recreational off-highway vehicle.
3. Requires an all-terrain vehicle that is also a recreational off-highway vehicle to be equipped with:
a) a steering wheel for control;
b) a rollover protective structure; and
c) an occupant retention system.
4. Makes technical and conforming changes.
5. Becomes effective on the general effective date.
