Relating to ballot forms
Provisions
1. Modifies ballot forms to require races for each office to be placed in the following order:
a. Section One – Nonpartisan Local Office Ballot
i. School district offices
ii. City and town offices
iii. All other nonpartisan offices
b. Section Two – Partisan Ballot
i. The several county and precinct offices
ii. The several state offices
iii. Representatives in Congress
iv. United States Senator
v. Presidential electors
c. Section Three – Nonpartisan Judicial Ballot (Sec. 1)
o Currently, partisan offices are in section one and nonpartisan offices are in section two (A.R.S. § 16-502).
2. Makes technical and conforming changes. (Sec. 1)
Current Law
A.R.S. § 16-502 outlines the form and contents of ballots. A ballot is required to contain the heading, "Official Ballot," with the words "type of election, (date of election)" and the name of the county and state in which the election is held. Immediately below the heading, a ballot is separated into two sections, which include a Partisan Ballot and a Nonpartisan Ballot.
A Partisan Ballot is required to include the names of candidates for offices in the following order: 1) President; 2) United States Senator; 3) Representatives in Congress; 4) the several state offices; and 5) The several county and precinct offices.
A Nonpartisan Ballot is required to include the names of candidates for judges of the Superior Court standing for election or retention, school district officials, justices of the Supreme Court, judges of the Court of Appeals and other nonpartisan officials.
