Abstract

Provisions

1.       Specifies that any fraction or portion of the 24-hour period from midnight to midnight constitutes the first day. (Sec. 1)

2.       Makes technical changes. (Sec. 1)

Current Law

The time in which an act is required to be done is computed by excluding the first day and including the last day, unless the last day is a holiday (A.R.S. §1-243).

Additional Information

The Arizona Court of Appeals recently ruled that a statute referring to a "day" means a 24-hour period beginning on one midnight and ending on the next ensuing midnight. (BSI HOLDINGS LLC v. ADOT)
