Relating to the fingerprinting of employees
by joint power authorities.
Provisions
1. Requires a fire district to require probationary employees in a firefighter position to submit a full set of fingerprints to a joint power authority formed with the district. (Sec. 1)
2. Requires the joint power authority to submit the fingerprints to ADPS for the purpose of obtaining a state and federal criminal records check. (Sec. 1)
3. Contains an emergency clause. (Sec. 2)
Current Law
Cities, towns, counties and fire districts may form separate legal entities for jointly exercising powers held in common by the contracting parties. Examples of powers that may be exercised by these entities include: fire protection, emergency medical services and medical ambulance services. The governing body of the entity is composed of officials elected to one or more of the governing bodies of the forming entity. These legal entities are considered political subdivisions of the state and have the governmental and proprietary powers in common to the contracting parties (A.R.S. § 48-805.01).
A fire district, through its board, must require probationary employees in a paid sworn firefighter, reserve firefighter or volunteer firefighter position to submit a full set of fingerprints to the district. The fire district is required to submit the fingerprints to ADPS for obtaining a state and federal criminal records check (A.R.S. § 48-805).
