Gold Star memorial
Purpose
Provides for the placement of a Gold Star memorial in the Wesley Bolin Plaza.
Background
The Arizona Gold Star military medal is awarded on behalf of the people of this state to individuals from Arizona who have been killed in military action from and after February 13, 1912, while engaged in an action against an enemy of the United States, engaged in military operations involving conflict with an opposing foreign force, service with friendly foreign forces engaged in an armed conflict against an opposing armed force in which the United States is not a belligerent party, or serving in a combat zone as designated by a presidential order (A.R.S. § 41-608.05). The medal was established by Laws 2009, Chapter 31.
According to the Arizona Department of Veterans' Services, 3,029 Arizonans have given their lives in defense of the nation since Arizona received statehood. The first Arizona Gold Star military medal presentation occurred on Memorial Day, May 30, 2016.
Pursuant to A.R.S. § 41-1363, a monument or memorial may only be erected on the Government Mall if a prior legislative act authorizes the monument or memorial. After authorization, statute requires: 1) the proponents of the monument or memorial to submit a concept to the Arizona Department of Administration (ADOA); 2) the ADOA to review the concept and determines the appropriate location for the memorial; 3) the ADOA to submit the recommendations to the Legislative Governmental Mall Commission (Commission); 4) the memorial language to be submitted to the Arizona Historical Advisory Commission for recommendations regarding the historical integrity of the monument; 5) the Commission to consult with the ADOA and approves monument or memorial; and 6) that the proponents of the monument or memorial enter into a contract with the ADOA specifying the conditions of final design, dimensions, location, maintenance requirements and the minimum dollar amount required for deposit in the state monument and memorial repair fund. Any approved monument or memorial must be completed and dedicated within two years after the effective date of the authorizing legislative act (A.R.S. § 41-1363).
The Commission consists of 10 appointed members and two advisory members and is required to review all planning activities within the Governmental Mall boundaries. The Governmental Mall is comprised of the area with a western boundary of 19th Avenue, a northern boundary of all lots abutting Van Buren Street, an eastern boundary of 7th Avenue and a southern boundary of the Harrison Street alignment (A.R.S. § 41-1362).
Public monies are not authorized to be used for the costs of creating and developing a memorial. All fund-raising and contracts for artistic design and construction of the memorial are the sole responsibility of the memorial’s proponents (A.R.S. § 41-1363).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Authorizes the ADOA to provide for the placement of a Gold Star memorial in the Wesley Bolin Plaza.
2. Confirms the establishment of the memorial is subject to statutory monument procedures.
3. Specifies that public monies are not authorized to pay for the costs of the memorial and prohibits the state from facilitating fundraising or establishing a fund for the deposit of monies.
4. Assigns responsibility of all fundraising and contracts for artistic design and construction of the memorial to the proponents.
5. Repeals this authority on October 1, 2020.
6. Becomes effective on the general effective date.
