AN ACT

 

amending Title 15, chapter 7, article 1, Arizona Revised Statutes, by adding section 15-701.02; relating to school curricula.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 15, chapter 7, article 1, Arizona Revised Statutes, is amended by adding section 15-701.02, to read:

START_STATUTE15-701.02.  Menu of local standards; requirements; rules

A.  The state board of education shall adopt a menu of local academic standards.  Beginning in the 2018‑2019 school year, each local education agency that offers instruction in grades nine through twelve may select from that menu academic standards for that local education agency instead of the state academic standards adopted by the state board of education pursuant to section 15‑701.01.  Beginning in the 2019‑2020 school year, each local education agency that offers instruction in grades three through eight may select from that menu academic standards for that local education agency instead of the state academic standards adopted by the state board of education pursuant to section 15‑701.

B.  Academic standards in use by a local education agency that are not on the menu of academic standards may be added to the menu at the request of the local education agency and on approval by the state board of education.  The state board of education shall annually evaluate local academic standards that are not on the menu pursuant to this section.

C.  A local education agency that selects local academic standards pursuant to this section meets the requirements prescribed in this title for state academic standards.  The local education agency shall include the name of the academic standards selected in the school report card required in section 15‑746.

D.  The state board of education shall adopt rules and procedures for the approval of local academic standards pursuant to this section.  Any rule or procedure adopted pursuant to this subsection may not require a local education agency to receive additional approval from the state board of education or the department of education to select academic standards from the menu of local academic standards pursuant to this section, except that a local education agency assigned a letter grade of D or F pursuant to section 15‑241 may not choose academic standards from the menu and shall continue to use the statewide minimum academic standards adopted by the state board of education pursuant to sections 15‑701 and 15‑701.01.

E.  The state board of education shall require that academic standards that are proposed to be considered for the menu of local academic standards meet all of the following requirements:

1.  Be high quality academic standards.

2.  meet or exceed the state board's adopted academic standards.

3.  Be able to be equated for state accountability programs, including establishing comparable student assessment scores and performance levels for achievement profiles and letter grade classifications issued pursuant to section 15‑241.

4.  Be evaluated by a third party approved by the state board of education that shows the academic standards meet the requirements prescribed in paragraphs 1, 2 and 3 of this subsection.

F.  A copy of assessment scores that are tied to the local academic standards shall be provided to the department of education when scores are provided to the local education agency. END_STATUTE
