FLOOR AMENDMENT EXPLANATION
The Barto Floor Amendment makes the following changes:
· Modifies requirements related to the Medical Board’s annual report, meeting videos and renewal forms and related information.
· Removes the requirement for the Board to remove disciplinary actions from their website after a certain period of time.
· Clarifies the type of complaints that the Executive Director is required to forward to a medical consultant.
· Removes references to a third-party vendor for criminal records checks.
· Requires the Board to post on its website the policy allowing a person’s identifying information to be withheld from a physician against whom there is a complaint and states the written agreements for this anonymity will be entered to the extent consistent with the administrative appeals process.
· Includes a rulemaking exemption.

"Sec. 10. Rulemaking exemption; Arizona medical board
For the purposes of implementing this act, to adjust renewal time frames and to modify current rules consistent with section 41‑1080, Arizona Revised Statutes, the Arizona medical board is exempt from the rulemaking requirements of title 41, chapter 6, Arizona Revised Statutes, for one year after the effective date of this act, except that the board shall provide public notice and an opportunity for public comment on proposed rules at least thirty days before a rule is adopted or amended."
