AN ACT

 

amending title 44, chapter 9, Arizona Revised Statutes, by adding article 26; relating to retail used tire establishments.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 44, chapter 9, Arizona Revised Statutes, is amended by adding article 26, to read:

ARTICLE 26.  RETAIL USED TIRE ESTABLISHMENTS

START_STATUTE44-1382.  Sale of unsafe used tires prohibited; penalty

A.  A commercial business engaged in the sale or installation of unmounted used passenger and light truck tires in this state shall not do either of the following:

1.  Sell an unmounted, unsafe used tire to a consumer.

2.  Install an unsafe used tire on a vehicle.

B.  A used tire is unsafe if any of the following applies:

1.  The tire is worn to one‑sixteenth tread depth or less on any area of the tread.

2.  The tire has damage that exposes the reinforcing plies of the tire, including cuts, cracks, bulges, punctures, scrapes or wear.

3.  The tire has an improper repair.  For the purposes of this paragraph, "improper repair" means any of the following:

(a)  A repair to the tire in the tread shoulder or belt edge area.

(b)  A puncture that has not been both sealed or patched on the inside and repaired with a cured rubber stem or plug through to the outside.

(c)  A repair to the sidewall or bead area of the tire.

(d)  A puncture repair of damage that is larger than one‑quarter of one inch.

4.  The tire Shows evidence of prior use of a temporary tire sealant without evidence of a subsequent proper repair.

5.  The United States department of transportation tire identification number located on the tire sidewall is defaced or removed.

6.  The tire is involved in a safety recall.

7.  The tire has any inner liner or bead damage.

8.  The tire shows an Indication of internal separation such as bulges or local areas of irregular tread wear indicating possible tread or belt separation.

C.  The civil penalty for selling unsafe tires in violation of this section is five hundred dollars per tire.END_STATUTE
