·          Requires agencies to reduce expenditures from the listed funds in order to ensure a sufficient balance for the transfers.

·          Requires the transfers to be made as soon as practicable in order to avoid a shortfall in each fund.

·          Requires the Governor’s Office of Strategic Planning and Budgeting (OSPB), by May 1, 2011, to report to the JLBC on any FY 2010-11 fund transfers that remain outstanding as of April 15, 2011 and indicate when the transfer will be completed or additional steps needed to make the full transfer.

·          Requires OSPB, by August 1, 2011, to report to the JLBC on any FY 2011-12 fund transfers that remain outstanding as of July 15, 2011 and indicate when the transfer will be completed or additional steps needed to make the full transfer.

·          Allows a budget unit, in FY 2010-11 and FY 2011-12, to request a cash transfer between its own funds from the state comptroller to comply with a reduction or transfer required in this act.

·          Requires JLBC to review any requested transfer.

·          Prohibits monies from being transferred to or from a budget unit’s state GF appropriation.

·          Stipulates that the state comptroller shall coordinate with OSPB, and notify JLBC, of any cash transfers.

·          Requires the state comptroller to file a final report with JLBC and OSPB on all cash transfer activities no later than August 1, 2011 for the FY 2010-11 transfers and by August 1, 2012 for the FY 2011-12 transfers.

·          Deposits $105,373,700 of Vehicle License Tax (VLT) revenues to the state GF instead of the State Highway Fund (SHF) in FY 2011-12.

·          Transfers $448,000 from the Safety Enforcement and Transportation Infrastructure Fund to the State Highway Fund (SHF) in FY 2011-12.

·          Deposits $448,000 of VLT monies received in FY 2011-12 for distribution to the SHF into the state GF.

·          Grants Health Insurance Trust Fund negotiation and settlement authority to ADOA for debts incurred with the federal government for related fund transfers.

Payment Deferrals

·          Suspends $344,201,700 in AHCCCS acute care capitation payments in 2012 for up to two months and designates an interest rate of 0.5% a year.

·          Appropriates, in FY 2012-13, $112,600,700 from the state GF and $231,744,100 in federal Title XIX Expenditure Authority to AHCCCS for health plan payments deferred from FY 2011-12.

·          Defers 35,000,000 in DES payments for services provided in May and June 2012 until after July 1, 2012 and appropriates the same amount in FY 2012-13 from the state GF to DES. 

·          Specifies that the FY 2011-12 $42,000,000 DES payment deferral is for services provided in both May and June 2011, rather than June only and reduces the deferral to $35.000.000.

·          Prohibits payments to child care providers and May payments to providers of developmentally disabled services from being deferred in FY 2010-11 and 2011-12.

·          Defers $952,627,700 in BSA and Additional State Aid (ASIA) payments made to ADE in FY 2011-12 to FY 2012-13.  Excludes charter schools from the deferral.

·          Requires ADE to disburse the FY 2012-13 appropriation of $952,627,700 to the counties for the school districts by July 1, 2012 and no later than August 29, 2012 in amounts equal to the reductions in apportionment of BSA and ASIA reductions made due to the deferral of the same amount.

·          Mandates that school districts include in the revenue estimates that they use for computing their FY 2011-12 tax rates the monies that they will receive between July 1, 2012 and August 29, 2012.

·          Defers $200,000,000 of payments by the Arizona Board of Regents (ABOR) allocated to the state universities in the individual campus appropriations until after July 1, 2012 and appropriates the same amount to ABOR in FY 2012-13 and requires the Arizona Department of Administration to distribute these monies to ABOR no later than October 1, 2012.

·          Allows DHS, in FY 2010-11 to use monies in the IGA and ISA Fund as the state Medicaid match for behavioral health services.  Requires reporting to JLBC on any such use of the funds.

·          Reduces $10,000,000 in appropriations made to state agencies in FY 2011-12 and transfers that amount to the state GF.  States that JLBC and ADOA shall allocate the reductions in accordance with the benefit eligibility waiting period.

·          States that it is the intent of the Legislature that ADOA offer state employees an enhanced health savings account (HSA) option for 2012 plan year. 

·          Requires ADOA to submit a report to JLBC by January 31, 2012 on employer contribution savings associated with the HAS and requires ADOA and JLBC to determine and allocate corresponding reductions to state agencies.
