APPROVAL OF MINUTES

 

Senator Gray stated that without objection, the minutes of January 13, 2010, January 20, 2010 and January 27, 2010 were approved.

 

CONSIDERATION OF BILLS

 

SB 1088 – juveniles; discretionary transfer; adult court – HELD

 

Senator Gray announced that SB 1088 would be HELD.

 

SB 1116 – limited income withholding orders – HELD

 

Senator Gray announced that SB 1116 would be HELD.

 

SB 1169 – law enforcement officer; spouse; insurance – DO PASS AMENDED

 

Kendra Kovarik, Public Safety and Human Services Committee Intern, explained SB 1169 and the 12-line Gray amendment dated 02/02/10 at 1:19 p.m. (Attachment A).

 

Senator Russell Pearce, bill sponsor, further explained SB 1169.

 

Senator Gray noted the individuals who registered their position on the bill (Attachment B).

 

Lt. Wayde Webb, Government Liaison, Arizona Department of Public Safety (DPS), testified in support of SB 1169.

 

Angela Harrolle, spouse of fallen DPS officer, testified in support of SB 1169.

 

Senator Allen moved SB 1169 be returned with a DO PASS recommendation.

 

Senator Allen moved the 12-line Gray amendment dated 02/02/10 at 1:19 p.m. (Attachment A) be ADOPTED.  The motion CARRIED by a voice vote.

 

Senator Allen moved SB 1169 be returned with an AS AMENDED, DO PASS recommendation.  The motion CARRIED with a roll call vote of 5-0-1 (Attachment 1).

 

SB 1261 – families of fallen officers fund – DO PASS

 

Kendra Kovarik, Public Safety and Human Services Committee Intern, explained SB 1261.

 

Andy Swann, President, Associated Highway Patrolmen of Arizona and Arizona Concerns of Police Survivors, testified in support of SB 1261.

 

Senator Gray noted the individuals who registered their position on the bill (Attachment B).

 

Cathie Buckmister, Arizona Concerns of Police Survivors, testified in support of SB 1261.

 

Senator Allen moved SB 1261 be returned with a DO PASS recommendation.  The motion CARRIED with a roll call vote of 5-0-1 (Attachment 2).

 

EXECUTIVE NOMINATIONS

 

Charles Ryan – Director, State Department of Corrections – CONFIRMATION RECOMMENDED

 

Mr. Ryan reviewed his resume and answered questions posed by the committee.

 

Donna Hamm, Executive Director, Middle Ground Prison Reform, testified in support of the nomination.

 

Terry Stewart, Court Administrator, Maricopa JP Bench, testified in support of the nomination.

 

Senator Gray noted the individuals who registered their position on the nomination (Attachment B).

 

Senator Allen moved the Committee on Public Safety and Human Services recommend to the full Senate the CONFIRMATION of Charles Ryan as the Director of the State Department of Corrections.  The motion CARRIED with a roll call vote of 5-0-1 (Attachment 3).

 

Joe Anderson – Member, Arizona Public Safety Communications Advisory Commission – CONFIRMATION RECOMMENDED

 

Mr. Anderson reviewed his resume and answered questions posed by the committee.

 

Senator Allen moved the Committee on Public Safety and Human Services recommend to the full Senate the CONFIRMATION of Joe Anderson as a Member of the Arizona Public Safety Communications Advisory Commission.  The motion CARRIED with a roll call vote of 5-0-1 (Attachment 4).

 

Robert Halliday – Director, Department of Public Safety – HELD

 

The nomination of Robert Halliday was HELD.

SB 1011 – concealed weapons; faculty; school grounds – HELD

John Thomas, Arizona Association of Chiefs of Police, testified in opposition to SB 1011.

Anthony Daykin, Chief of Police, University of Arizona Police Department, testified in opposition to SB 1011.

Senator Allen moved SB 1114 be returned with a DO PASS recommendation.  The motion CARRIED with a roll call vote of 5-0-1 (Attachment 7).

 

SB 1122 – prison contraband; wireless communication device – DO PASS

 

Bill Ritz, Government Institutions Committee Assistant Analyst, explained SB 1122.

 

Senator Gray noted the individuals who registered their position on the bill (Attachment B).

 

Senator Allen moved SB 1122 be returned with a DO PASS recommendation.  The motion CARRIED with a roll call vote of 5-0-1 (Attachment 8).

 

SB 1123 – prisoners; community corrections; monitoring; fees – DO PASS AMENDED

 

Amber O’Dell, Public Safety and Human Services Committee Analyst, explained SB 1123 and the 4-page Melvin amendment dated 02/02/10 at 1:26 p.m. (Attachment D).

 

Jennifer Bowser, Arizona Department of Corrections, answered questions posed by the committee.

 

Senator Melvin moved SB 1123 be returned with a DO PASS recommendation.

 

Senator Melvin moved the 4-page Melvin amendment dated 02/02/10 at 1:26 p.m. (Attachment D) be ADOPTED.  The motion CARRIED by a voice vote.

 

Senator Melvin moved SB 1123 be returned with an AS AMENDED, DO PASS recommendation.  The motion CARRIED with a roll call vote of 5-0-1 (Attachment 9).

SB 1162 – domestic relations committee; membership – DO PASS

SB 1266 – juveniles; communication devices; sexual material – DO PASS

 

Amber O’Dell, Public Safety and Human Services Committee Analyst, explained SB 1266.

 

Paul Ahler, Executive Director, Arizona Prosecuting Attorneys' Council, testified in support of SB 1266.

 

Senator Gray noted the individuals who registered their position on the bill (Attachment B).

 

Senator Allen moved SB 1266 be returned with a DO PASS recommendation.  The motion CARRIED with a roll call vote of 5-0-1 (Attachment 11).
