HB2467 requires that an agency must verify that an applicant is lawfully present in the United States in order to issue a license.
Current statutes (Arizona Revised Statutes § 28-3153; § 28-3158; and § 28-3165) require the Motor Vehicle Division (MVD) to verify the applicant’s authorized presence in the United States, and the applicant’s Social Security Number (SSN). In addition, the applicant must submit proof satisfactory to MVD of the applicant’s full legal name, date of birth, sex and residence address. According to MVD policy, applicants must present two documents, one of which must contain a clear photo of the applicant. If the applicant does not have any of the Arizona Department of Transportation approved documents with a photo, MVD policy allows the applicant to submit three documents to determine eligibility. One of the documents submitted to the MVD must be a primary form of identification.
· Prohibits an agency from issuing a license to any applicant who is unlawfully present or residing in the United States.
· Requires an agency to verify that an applicant is lawfully present in the United States before issuing or renewing a license.
