AN ACT

 

Amending title 36, chapter 29, ARTICLE 1, Arizona Revised Statutes, by adding section 36-2907.02; relating to the Arizona health care cost containment system.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 36, chapter 29, article 1, Arizona Revised Statutes, is amended by adding section 36-2907.02, to read:

START_STATUTE36-2907.02.  Medication therapy management; covered services

A.  Subject to the availability of monies, the administration shall contract for the provision of medication therapy management services to provide the following pharmaceutical care services to members by a pharmacist licensed pursuant to title 32, chapter 18 in order to optimize the therapeutic outcomes of the member's medications:

1.  Performing or obtaining necessary assessments of the member's health status.

2.  Formulating a medication treatment plan.

3.  Monitoring and evaluating the member's response to therapy, including safety effectiveness and outcomes.

4.  Performing a comprehensive medication review to identify, resolve and prevent medication related problems, including adverse drug events.

5.  Documenting the care delivered and communicating essential information to the member's other primary care providers.

6.  Providing verbal education and training to enhance the member's understanding and the appropriate use of the member's medications.

7.  Providing information, support services and resources to enhance the member's adherence to the member's therapeutic regimens.

8.  Coordinating and integrating medication therapy management services within the broader health care management services being provided to the member.

B.  This section does not expand or modify the scope of practice of a pharmacist licensed pursuant to title 32, chapter 18.

C.  To be eligible for reimbursement pursuant to this chapter, a pharmacist must:

1.  Be actively licensed pursuant to title 32, chapter 18.

2.  Have graduated from an accredited college of pharmacy and completed a structured and comprehensive education program, or have a drug therapy management agreement pursuant to rules adopted by the Arizona state board of pharmacy, relating to the provision and documentation of pharmaceutical care management services that has both clinical and didactic elements.

3.  Be practicing:

(a)  In an ambulatory care setting as part of a multidisciplinary team.

(b)  Pursuant to a structured patient care process that is offered in a private or semiprivate patient care community practice setting that is separate from the commercial business that also occurs in the setting

(c)  In a management call center that is based in a college of pharmacy located in this state.

(d)  In a setting approved by the Arizona state board of pharmacy.

4.  Use an electronic patient record system that meets standards prescribed by the administration.

D.  For the purposes of reimbursement for medication therapy management services, the administration may enroll individual pharmacists.  The administration may also establish contact requirements between the pharmacist and the member, including limiting the number of reimbursable consultations per member. Sec. 2.  Medication therapy management; evaluation; report; advisory committee

A.  The director of the Arizona health care cost containment system administration shall evaluate the effectiveness of the medication therapy management services provided pursuant to section 36-2907.02, Arizona Revised Statutes, as added by this act, and submit a report of the director's findings to the governor, the speaker of the house of representatives and the president of the senate on or before November 15, 2010.  The director shall provide a copy of this report to the secretary of state and the director of the Arizona state library, archives and public records.

B.  In conducting the evaluation pursuant to subsection A of this section, the director shall convene an advisory committee to solicit comments and to make recommendations regarding the effectiveness, implementation and administration of the services provided pursuant to section 36-2907.02, Arizona Revised Statutes, as added by this act.  The committee shall include:

1.  A member of the Arizona state board of pharmacy.

2.  A member of the Arizona medical board.

3.  Two physicians who are licensed pursuant to title 32, chapter 13 or 17, Arizona Revised Statutes.

4.  Two pharmacists who are licensed pursuant to title 32, chapter 18, Arizona Revised Statutes.

5.  Two consumers of services provided pursuant to section 36-2907.02, Arizona Revised Statutes, as added by this act.

6.  Three members who have expertise in the area of medication therapy management.

C.  Committee members appointed pursuant to subsection B of this section serve at the pleasure of the director and are not eligible for compensation or reimbursement of expenses.
