FACT SHEET FOR H.B. 2231

 

state employees; annual leave transfers

 

Purpose

 

            Allows covered state employees to transfer annual leave to other state employees who have been seriously incapacitated and disabled by pregnancy or childbirth. 

 

Background

 

            State employees covered under the Arizona Department of Administration (ADOA) personnel system accrue annual leave based on the employee’s years of service.  An employee must forfeit accumulated annual leave in excess of 240 hours at the end of the calendar year, unless an exception is authorized by the ADOA Director.  Statute allows an employee to donate annual leave to another state employee in the same agency or a family member from another agency.  The recipient employee may use the donated annual leave to care for oneself or an immediate family member who has a seriously incapacitating illness or injury.  Donated annual leave is calculated in proportion to the hourly rate of pay of the donating employee and the recipient employee. 

 

            The ADOA personnel rules provides for “parental leave” as any combination of annual leave, sick leave, compensatory leave or leave without pay taken by an employee due to pregnancy, childbirth, miscarriage, abortion or adoption of children.  Parental leave is limited to 12 weeks. 

 

            According to ADOA, there is no fiscal impact to the state associated with this legislation. 

 

Provisions

 

1.      Allows state employees to donate annual leave to other state employees under the ADOA personnel system if the recipient employee has a seriously incapacitating and extended disability that is caused by pregnancy or childbirth. 

 

2.      Makes technical changes.

 

3.      Becomes effective on the general effective date.
