MAKING AN APPROPRIATION TO THE ARIZONA CRIMINAL JUSTICE COMMISSION FOR
OBSCENITY PROSECUTIONS.
Be it enacted by the Legislature of the State of Arizona:
Section 1.
A. The sum of $250,000 is appropriated from the state general fund in fiscal year 1997-1998 and $250,000 in fiscal year 1998-1999 to the Arizona criminal justice commission to enhance the prosecution of obscenity crimes. The commission shall use the monies to establish grants to county attorneys to improve the detection and prosecution of violations of laws relating to obscenity in title 13, chapter 35, Arizona Revised Statutes. Monies granted shall not be used to supplant but are in addition to county monies allocated for the purposes provided in this section. The application and award process shall be as determined by the commission.
B. The Arizona criminal justice commission shall submit a report regarding the grant program to the governor, the president of the senate and the speaker of the house of representatives by March 1, 1998 that shall describe the success of the grant program and list the participants receiving grants and expenditure detail.
C. The appropriation made in subsection A of this section is exempt from the provisions of section 35-190, Arizona Revised Statutes, relating to lapsing of appropriations.
