AN ACT

 

Appropriating monies to the department of health services for education, training and research relating to medical marijuana.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Appropriations; department of health services; medical marijuana fund; fiscal year 2017‑2018

A.  Subject to the requirements of article IV, part 1, section 1, Constitution of Arizona and notwithstanding section 36‑2817, Arizona Revised Statutes, the following amounts are appropriated from the medical marijuana fund established by section 36‑2817, Arizona Revised Statutes, in fiscal year 2017‑2018 to the department of health services for the following purposes:

1.  The sum of $2,000,000, on request from the department of health services, to the Arizona peace officer standards and training board to educate and train peace officers in the new dynamics created by the Arizona medical marijuana act regarding properly policing marijuana laws.

2.  The sum of $2,000,000. on request from the department of health services, to Arizona state university's college of public service and community solutions to research, educate and create reports regarding the impact and change of marijuana and drug policy on the residents of this state, specifically in reference to the Arizona medical marijuana act.

3.  The sum of $2,000,000, on request from the department of health services, to the university of Arizona college of medicine to further scientific research on internal projects or to seek funding from outside sources to further understand the impact of marijuana as medicine, including pharmaceutical‑level studies and research or studies on the marijuana plant.

4.  The sum of $2,500,000, to be made available on request from the department of health services, in the following amounts to develop and implement programs to educate residents about substance abuse prevention in relation to marijuana:

(a)  $750,000 to the county superintendent of schools in a county with a population of at least one million five hundred persons.

(b)  $750,000 to the county superintendent of schools in a county with a population of at least five hundred thousand persons and less than one million five hundred persons.

(c)  $750,000 to the county superintendent of schools in a county with a population of less than five hundred thousand persons.

B.  Any monies appropriated pursuant to subsection A of this section that are not requested on or before June 30, 2018 from the department of health services shall revert to the medical marijuana fund established by section 36‑2817, Arizona Revised Statutes.

Sec. 2.  Requirements for enactment; three-fourths vote

Pursuant to article IV, part 1, section 1, Constitution of Arizona, this act is effective only on the affirmative vote of at least three‑fourths of the members of each house of the legislature.
