AN ACT

 

repealing section 8‑530.01, Arizona Revised Statutes; amending Title 8, chapter 4, article 4, Arizona Revised Statutes, by adding a new section 8‑530.01; relating to child welfare and placement.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Repeal

Section 8-530.01, Arizona Revised Statutes, is repealed.

Sec. 2.  Title 8, chapter 4, article 4, Arizona Revised Statutes, is amended by adding a new section 8-530.01, to read:

START_STATUTE8-530.01.  Child returning to out-of-home care; placement

If a child has been returned to a parent and is subsequently returned to out‑of‑home care and the department cannot locate an appropriate and available relative or other suitable person as prescribed in section 8‑514, the preferred placement for the child is in a foster family home where the child was previously placed if the following conditions are met:

1.  The foster family home is available and willing to care for the child.

2.  The foster family is appropriate and able to meet the child's needs.

3.  The placement is in the best interests of the child. END_STATUTE
