AN ACT

 

Amending title 9, chapter 4, article 8, Arizona Revised Statutes, by adding section 9-500.41; amending title 11, chapter 2, article 4, Arizona Revised Statutes, by adding section 11-269.19; amending title 41, chapter 50, article 1, Arizona Revised Statutes, by adding section 41-5002; amending title 48, chapter 1, Arizona Revised Statutes, by adding article 14; relating to service access cards.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 9, chapter 4, article 8, Arizona Revised Statutes, is amended by adding section 9-500.41, to read:

START_STATUTE9-500.41.  Municipal service access cards; requirements; prohibitions; applicability

A.  If a city or town issues a municipal service access card to an individual to provide access to municipal services that the individual is entitled to receive from the city or town, the city or town shall:

1.  Label the municipal service access card, in at least twelve‑point bold‑faced type, with the words "for use to access  (name of issuing governmental entity)  services only, not an identification card".  A city or town may supplement the statement required in this paragraph with wording in twelve-point type or smaller with the words "because this card was issued based on less reliable secondary identification, it may only be used to access  (name of issuing governmental entity)  government services." The card may also state "This card may be used to access discounts or offers from other participating governmental entities or private parties".

2.  List on the municipal service access card only the services that the individual to whom the card is issued is legally entitled to receive.

3.  Not print the word "identification" on the card except to state that the municipal service access card is not an identification card.

B.  A city or town that issues a municipal service access card that is also an identification card or any other type of identification card to an individual to access municipal services that the individual is entitled to receive from the city or town shall:

1.  Adopt procedures that are at least as stringent as the procedures adopted by the motor vehicle division of the department of transportation for issuing a nonoperating identification license.

2.  Require the individual to submit the same information and proof necessary to obtain a nonoperating identification license pursuant to section 28‑3165, subsection F.

3.  Accept only the documents approved by the motor vehicle division of the department of transportation as acceptable proof of identity.

C.  A municipal service access card issued pursuant to this section may not Have the same color scheme or design format as a driver license issued pursuant to section 28‑3153 or a nonoperating identification license issued pursuant to section 28‑3165.

D.  This section applies to municipal service access cards that are issued by a third party on behalf of a city or town. END_STATUTE

Sec. 2.  Title 11, chapter 2, article 4, Arizona Revised Statutes, is amended by adding section 11-269.19, to read:

START_STATUTE11-269.19.  County service access cards; requirements; prohibitions; applicability

A.  If a county issues a county service access card to an individual to provide access to county services that the individual is entitled to receive from the county, the county shall:

1.  Label the county service access card, in at least twelve-point bold-faced type, with the words, "for use to access  (name of issuing governmental entity)  services only, not an identification card".  A county may supplement the statement required in this Paragraph with wording in twelve-point type or smaller with the words "Because this card was issued based on less reliable secondary identification, it may only be used to access  (name of issuing governmental entity)  government services."  The card may also state "This card may be used to access discounts or offers from other participating GOVERNMENTal entities or private parties".

2.  List on the county service access card only the services that the individual to whom the card is issued is legally entitled to receive.

3.  Not print the word "identification" on the card except to state that the county service access card is not an identification card.

B.  A county that issues a county service access card that is also an identification card or an identification card to an individual to access county services that the individual is entitled to receive from the county shall:

1.  Adopt procedures that are at least as stringent as the procedures adopted by the motor vehicle division of the department of transportation for issuing a nonoperating identification license.

2.  Require the individual to submit the same information and proof necessary to obtain a nonoperating identification license pursuant to section 28-3165, subsection F.

Sec. 3.  Title 41, chapter 50, article 1, Arizona Revised Statutes, is amended by adding section 41-5002, to read:

START_STATUTE41-5002.  Service access cards; requirements; prohibitions; applicability; definition

A.  If an agency of this state issues a service access card to an individual to provide access to services that the individual is entitled to receive from the agency, the agency shall:

1.  Label the service access card, in at least twelve-point bold‑faced type, with the words "for use to access  (name of issuing governmental entity)  services only, not an identification card".  An agency may supplement the statement required in this paragraph with wording in twelve-point type or smaller with the words "because this card was issued based on less reliable secondary identification, it may only be used to access  (name of issuing GOVERNMENTal entity)  government services." the card may also state "this card may be used to access discounts or offers from other participating government or private parties".

2.  List on the service access card only the services that the individual to whom the card is issued is legally entitled to receive.

3.  Not print the word "identification" on the card except to state that the service access card is not an identification card.

Sec. 4.  Title 48, chapter 1, Arizona Revised Statutes, is amended by adding article 14, to read:

ARTICLE 14. SERVICE ACCESS AND IDENTIFICATION CARD VERIFICATION

START_STATUTE48-295.  Service access cards; requirements; prohibitions; applicability; definition

A.  If a district of this state issues a service access card to an individual to provide access to services that the individual is entitled to receive from the district, the district shall:

1.  Label the service access card, in at least twelve-point bold‑faced type, with the words "for use to access  (name of issuing governmental entity)  services only, not an identification card".  A district may supplement the statement required in this paragraph with wording in twelve-point type or smaller with the words "because this card was issued based on less reliable secondary identification, it may only be used to access  (name of issuing GOVERNMENTal entity)  government services." the card may also state "this card may be used to access discounts or offers from other participating governmental entities or private parties".

2.  List on the service access card on the services that the individual to whom the card is issued is legally entitled to receive.

3.  not print the word "identification" on the card except to state that the service access card is not an identification card.

Sec. 5.  Applicability; legislative findings

A.  Section 9‑500.41, Arizona Revised Statutes, as added by this act, applies to all municipal service access cards issued, reissued or renewed on or after the effective date of this act.  A municipal service access card that is issued before the effective date of this act is valid for one year after the effective date of this act.

B.  The legislature finds that the reliability and standards for issuance of identification cards issued in this state is a matter of statewide concern.  The reliability of a validly issued identification card is essential to prevent identity theft, protect the reputation and integrity of government issued identification cards and promote commerce.
