AN ACT

 

amending section 16-250, Arizona Revised Statutes; relating to the presidential preference election.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Section 16-250, Arizona Revised Statutes, is amended to read:

START_STATUTE16-250.  Expenses of election

A.  The secretary of state in consultation with the county recorders and the county officers in charge of elections shall include in the budget request for the department of state sufficient monies from the state general fund to conduct the presidential preference election prescribed by this article.

B.  Reimbursement of charges incurred by the counties for the presidential preference election shall be made in the an amount of one dollar twenty‑five cents for each active registered voter in the county on January 1 of the year of the presidential preference election as evidenced by a proper claim submitted to the secretary of state as follows:

1.  For counties with an official active voter registration total of four hundred fifty thousand persons or more, in the amount of the actual expenses incurred up to the amount of $3.00 for each active registered voter in the county, whichever is less.

2.  For counties with an official active voter registration total of thirty-five thousand persons or more and less than four hundred fifty thousand persons, in the amount of the actual expenses incurred up to the amount of $3.50 for each active registered voter, whichever is less.

3.  For counties with an official active voter registration total of less than thirty-five thousand persons, in the amount of the actual expenses incurred up to the amount of $4.00 for each active registered voter, whichever is less.

C.  If reimbursing for actual expenses incurred as prescribed by subsection B of this section, the secretary of state shall not reimburse counties for Any expenditure that is not reimbursable as prescribed by the state accounting manual issued by the department of administration and in effect on January 1 in the year preceding the election.  The secretary of state shall provide detailed information to county recorders and other officers in charge of elections regarding the substantive requirements of the relevant portions of the state accounting manual and a standard format for submittal of a proper claim.

D.  If the secretary of state determines that reimbursement at the rate prescribed by this subsection B of this section would jeopardize the ability of a county to comply with federal and state laws and regulations, the secretary of state may release the county from that rate of reimbursement.
