AN ACT

 

Amending Title 37, chapter 9, article 1, Arizona Revised Statutes, by adding section 37-1308; relating to the Arizona department of forestry and fire management.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 37, chapter 9, article 1, Arizona Revised Statutes, is amended by adding section 37-1308, to read:

START_STATUTE37-1308.  Permit to clear forestry waste; definition

A.  The state forester may:

1.  Issue a permit to any person to clear forestry waste in the nonfederal forested lands in this state to protect against wildfires.

2.  Establish an application process and fee in rule for the purposes of this section.

B.  For the purposes of this section, "forestry waste" includes deadfall trees, pinion juniper trees, trees killed by beetles and any other nonmerchantable forestry goods. END_STATUTE
