"b. THE RETAILER AND PRIVATE LABEL LENDER SHALL MAINTAIN ADEQUATE BOOKS, RECORDS OR OTHER DOCUMENTATION SUPPORTING THE CHARGE OFF OF THE DEBT FOR WHICH A DEDUCTION IS TAKEN OR REFUND IS CLAIMED UNDER THIS SECTION. A RETAILER CLAIMING A DEDUCTION OR REFUND FOR BAD DEBT FROM SALES MADE USING A PRIVATE LABEL CREDIT CARD SHALL MEET THE SAME STANDARD OF DOCUMENTATION AS A RETAILER THAT CLAIMS A DEDUCTION OR REFUND OF BAD DEBTS THAT ARE FROM SALES MADE NOT USING A PRIVATE LABEL CREDIT CARD. A RETAILER CLAIMING A DEDUCTION OR REFUND FOR BAD DEBTS FROM SALES MADE USING A PRIVATE LABEL CREDIT CARD MUST EITHER USE AN APPORTIONMENT METHOD OR A SPECIFIED PERCENTAGE METHOD TO ALLOCATE THE AMOUNT OF THE DEDUCTION OR REFUND TO SPECIFIC TAXING JURISDICTIONS. ON REQUEST, THE DEPARTMENT MAY REQUIRE THE RETAILER TO SUBSTANTIATE THE METHOD USED. THE REASONABLENESS OF THE METHOD IS SUBJECT TO AUDIT BY THE DEPARTMENT.
c. THE DEDUCTION PROVIDED BY THIS SECTION does NOT APPLY TO BAD DEBTS ARISING FROM THE SALE OF TITLED PROPERTY."
