AN ACT

 

amending Title 41, chapter 32, article 1, Arizona Revised Statutes, by adding section 41-3509; relating to government information technology.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 41, chapter 32, article 1, Arizona Revised Statutes, is amended by adding section 41-3509, to read:

START_STATUTE41-3509.  Computer systems; software; sale or lease; deposit

A.  Notwithstanding section 41‑2752, a budget unit may produce software or computer systems and provide the software or computer systems and associated services and intellectual property to other budget units at no cost or offer the software or computer systems and associated services and intellectual property for sale or lease to other budget units or government agencies or private entities.

B.  The budget unit shall deposit, pursuant to sections 35‑146 and 35‑147, sixty percent of the profit from the monies generated by the sale or lease of the software or computer systems and associated services and intellectual property pursuant to subsection A of this section in the state general fund, and the remaining forty percent may be retained by the budget unit.
