Page 3, after line 8, insert:
“Sec. 2. Section 41-121.02, Arizona Revised Statutes, is amended to read:
41-121.02. Department of state
A. There is established the department of state, which shall be composed of the office of the secretary of state.
B. The secretary of state shall have charge of and direct the department of state.
C. Except as otherwise provided by law, employees of the department of state are subject to chapter 4, article 4 and, as applicable, articles 5 and 6 of this title.
D. Purchases and contracts for goods and services entered into by the Arizona state library, archives and public records are exempt from chapter 23 of this title.
E. The Arizona state library, archives and public records is exempt from chapter 6 of this title.
F. EACH APPLICANT AND CURRENT EMPLOYEE OF THE DEPARTMENT of state WHO HAS ACCESS TO PERSONAL INFORMATION PURSUANT TO ARTICLES 2.1 AND 3 OF THIS CHAPTER AND SECTION 16-168, SUBSECTION J SHALL SUBMIT A FULL SET OF FINGERPRINTS TO THE DEPARTMENT OF STATE FOR THE PURPOSE OF OBTAINING A STATE AND FEDERAL CRIMINAL RECORDS CHECK PURSUANT TO SECTION 41-1750 AND PUBLIC LAW 92-544. THE DEPARTMENT OF PUBLIC SAFETY MAY EXCHANGE THIS FINGERPRINT DATA WITH THE FEDERAL BUREAU OF INVESTIGATION. THE APPLICANT OR EMPLOYEE SHALL
PAY TO THE DEPARTMENT OF PUBLIC SAFETY THE FINGERPRINT FEE IN AN AMOUNT THAT IS DETERMINED BY THE DEPARTMENT OF PUBLIC SAFETY.”
