FLOOR AMENDMENT EXPLANATION

 

Requires the Game and Fish Commission to enter into a memorandum of understanding with the US Fish and Wildlife Service that a Mexican gray wolf may not be released, translocated or cross-fostered within three miles of State Trust land or private property or without a full DNA profile on each Mexican gray wolf released, translocated or cross-fostered.

 

Adds a severability clause.

“A. THE COMMISSION SHALL ENTER INTO A MEMORANDUM OF UNDERSTANDING WITH THE UNITED STATES FISH AND WILDLIFE SERVICE REGARDING THE ENDANGERED SPECIES ACT AND THE RELEASE, TRANSLOCATION AND CROSS-FOSTERING OF MEXICAN GRAY WOLVES IN THIS STATE. THE MEMORANDUM OF UNDERSTANDING SHALL INCLUDE THAT A MEXICAN GRAY WOLF RELEASE, TRANSLOCATION OR CROSS-FOSTERING MAY NOT OCCUR:”

"Sec. 2.  Severability

If a provision of this act or its application to any person or circumstance is held invalid, the invalidity does not affect other provisions or applications of the act that can be given effect without the invalid provision or application, and to this end the provisions of this act are severable."
