SENATE AMENDMENTS TO S.B. 1432

Strike everything after the enacting clause and insert:

“Section 1.  Title 44, chapter 11, Arizona Revised Statutes, is amended by adding article 26, to read:

ARTICLE 26.  INNKEEPER EMPLOYEES

START_STATUTE44-1799.95.  Employee guest room access; registered sex offenders prohibition; definition

A.  An innkeeper may not permit an employee who is required to register as a sex offender pursuant to section 13-3821 or the laws of another state or the United States department of justice to have access to the room of a registered guest of the inn.

B.  An innkeeper is deemed to have provided or permitted its employee to have access to the room of a registered guest of the inn if the innkeeper either:

1.  Allows an employee to possess a key or any other means of unlocking the door or other entry to the room of a registered guest.

2.  Fails to employ reasonable safeguards to prevent an employee from obtaining possession of a key or any other means of unlocking the door or other entry to the room of a registered guest.

C.  Before employing a prospective employee, an innkeeper must verify that the prospective employee who may be provided access to the room of a registered guest of the inn is not listed on the internet sex offender website established pursuant to section 13-3827 or the Dru Sjodin national sex offender public website established pursuant to 42 United States Code section 16920.  After employment, the innkeeper shall verify annually that the employee who may be or is provided access to the room of a registered guest of the inn is not listed as a sex offender on the internet sex offender website established pursuant to section 13-3827 or the Dru Sjodin national sex offender public website established pursuant to 42 United States Code section 16920.

D.  For the purpose of this section, "inn" includes a hotel, a boarding house, a lodging house, an apartment house and a motel."END_STATUTE
