AN ACT

 

repealing sections 28-336 and 28-338, Arizona Revised Statutes; amending title 28, chapter 8, article 1, Arizona Revised Statutes, by adding section 28-3007; relating to driver licenses.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Repeal

Sections 28-336 and 28-338, Arizona Revised Statutes, are repealed.

Sec. 2.  Title 28, chapter 8, article 1, Arizona Revised Statutes, is amended by adding section 28-3007, to read:

START_STATUTE28-3007.  REAL ID license; enhanced license; issuance

A.  A person may apply to the department for a driver license or nonoperating identification license that complies with the REAL ID act of 2005 (P.L. 109-13, division B; 119 Stat. 302) and that meets all of the requirements of the United States department of homeland security for a REAL ID compliant credential.  On receipt of a proper application, the department shall issue a license that bears a United States department of homeland security approved marking reflecting that the license meets REAL ID requirements.

B.  A person may apply to the department for an enhanced driver license that meets the requirements of the Western Hemisphere Travel Initiative and the United States department of homeland security governing enhanced driver licenses.  On receipt of a proper application, the department shall issue an enhanced driver license that complies with the requirements prescribed under the Western Hemisphere Travel Initiative.

C.  All provisions of this chapter relating to the issuance of licenses apply to a license that is issued in compliance with this section. END_STATUTE
