AN ACT

 

Amending Title 9, chapter 4, article 8, Arizona Revised Statutes, by adding section 9-500.33; relating to municipal consultants.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 9, chapter 4, article 8, Arizona Revised Statutes, is amended by adding section 9-500.33, to read:

START_STATUTE9-500.33.  Fee consultants; infrastructure improvements plan; definitions

A.  If a consultant provides a city or town with work, services, studies, planning, surveys or other preparatory work that is related to calculating, assessing or collecting fees, including development fees pursuant to section 9-463.05, the consultant shall identify and explain in the infrastructure improvements plan the reasons for providing different methodologies, analyses or recommendations if the consultant provided similar services to one or more other cities or towns in this state in the twelve months before the date of the contract.

B.  For the purposes of this section:

1.  "Consultant" means a person that provides professional advice or services to a city or town under a contract that does not involve the traditional relationship of employer and employee.  Consultant does not include the federal government, a state governmental entity, an attorney who is licensed to practice law in this state or a certified public accountant who is licensed by the Arizona state board of accountancy.

2.  "Studies" include the land use assumptions, infrastructure improvements plans and fee studies required by section 9-463.05. END_STATUTE
