AN ACT

 

Amending title 41, chapter 23, article 1, Arizona Revised Statutes, by adding section 41‑2505; relating to government procurement.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 41, chapter 23, article 1, Arizona Revised Statutes, is amended by adding section 41-2505, to read:

START_STATUTE41-2505.  Government procurement; American products; exception

A.  Notwithstanding any other law, in the procurement of goods or services, a procurement officer of this state, an agency of this state, a county or a city or town, if feasible, shall purchase goods, articles, materials and services that are manufactured in or derived from the United States or any place subject to the jurisdiction of the United States.

B.  This section does not apply if such a purchase:

1.  Is prohibited by federal law or treaty.

2.  Is inconsistent with the public interest or unreasonable in cost.

3.  Is for products that are not produced or manufactured in the United States in sufficient and reasonably available commercial quantities and of satisfactory quality. END_STATUTE
