AN ACT
amending title 41, chapter 23, Arizona Revised Statutes, by adding article 14; relating to the APPEAL of SOLICITATIONS AND CONTRACT AWARDS.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 41, chapter 23, Arizona Revised Statutes, is amended by adding article 14, to read:
ARTICLE 14. APPEAL OF SOLICITATIONS AND CONTRACT AWARDS
41-2691. Appeal of solicitations and contract awards; evidence; definition
A. At a hearing held pursuant to chapter 6, article 10 of this title, the administrative law judge shall allow the protesting party to present evidence to rebut the defense of the intervenors or the findings of the chief procurement officer, including evidence that was not filed with the agency within any applicable protest period after receipt of the agency report or any relevant evidence disclosed by this state or intervenors after the protest period.
B. For the purposes of this section, "relevant evidence" means all issues that are raised by the appealing party and that were not dismissed by the department before the solicitation or contract award is appealed pursuant to chapter 6, article 10 of this title.
