Summary of the Proposed Strike-Everything Amendment to SB 1045

The proposed strike-everything amendment to SB 1045 is an emergency measure that prohibits a municipality from enacting or enforcing an ordinance that requires a business to regulate access to privacy areas.

History

Pursuant to Arizona Revised Statutes (A.R.S.) § 41-1442, it is unlawful to discriminate against a person based on race, color, religion, sex, national origin, or ancestry in places of public accommodation.  Furthermore, statute states no person shall refuse, deny, or withhold accommodations, advantages, facilities, or privileges, nor make a connection between a person and the price or quality of any item or service offered at a place of public accommodation because of race, color, religion, sex, national origin, or ancestry.  A person may be removed from any place of public accommodation if they are under the influence of alcohol or narcotics, lewd, or physically violent regardless of race, color, religion, sex, national origin, or ancestry.

Statute defines places of public accommodation as all public places of entertainment, amusement, or recreation, places where food or beverages are sold for consumption, places which are conducted for the lodging of transients, and all establishments which cater or offer their services, facilities, or goods to members of the general public.  Certain dwellings as defined by statute, private clubs, or any place which is in its nature distinctly private is not a place of public accommodation (A.R.S. § 41-1441).

Provisions

·          States the regulation of access to privacy areas in places of public accommodation based on gender identity or expression is of state-wide concern and is not subject to further regulation by a county, city, town, or other political subdivision of this state.

·          Prohibits a county, city, town, or other political subdivision of this state from enacting or enforcing an ordinance or policy requiring a person or business to regulate access to privacy areas based on gender identity or expression.

·          Grants a person or business immunity from being civilly or criminally liable for denying access to privacy areas based on gender identity or expression.

·          Authorizes a person or business to permit individuals access to privacy areas based on gender identity or expression.

·          Specifies any ordinance or policy relating to access to privacy areas based on gender identity or expression that is inconsistent with these provisions is void.

·          Defines gender identity or expression and privacy areas.

·          Contains an emergency clause.
