"Sec. 25 Board of behavioral health examiners; applications; factors for review
A. Until January 1, 2017, notwithstanding section 32-3275, subsection A, paragraph 7, Arizona Revised Statutes, as amended by this act, for applications submitted after the effective date of this act, the board of behavioral health examiners, if requested by the applicant, may not base a decision solely on a finding by the board that an applicant had a license refused on the grounds of unprofessional conduct or a license revoked as a result of a final order of the board that was not the result of a consent agreement or surrender of the license after July 1, 2004. The board may conduct a de novo hearing concerning the conduct that constituted the grounds for the previous revocation or denial by the board. The board may consider evidence presented at the time of the original denial or revocation or any new evidence presented on behalf of the board or the applicant.
B. This section does not apply if the records of the original complaint or denial have been destroyed pursuant to title 41, chapter 1, article 2.1, Arizona Revised Statutes."
