FUNCTION OF THE Arizona State land department board of appeals:

Pursuant to A.R.S. § 37-215, all state land sales and commercial leases are required to be approved by the Arizona State Land Department Board of Appeals (Board), which also serves as an administrative review board.  The Board consists of five members who are appointed by the Governor to six-year terms.  Applicants and lessees may appeal to the Board a final decision of the State Land Commissioner (Commissioner) that relates to appraisals and classifications. If an appeal is filed, the Board is required to hold a hearing within 120 days (of the notice of appeal date) in the county in which the major portion of the land involved in the appeal is located.  Within 60 days of the hearing, the Board must furnish a written copy of its findings and decision to all parties of the appeal. The Board also reviews and approves participation contracts (A.R.S. § 37-214). A participation contract is a contract arising out of a sale where the State Land Department receives a share of the revenues generated by subsequent sales or leases.

 

STATUTORY REQUIREMENTS FOR POSITION:

In order to be eligible for appointment, a person must be experienced in the classification and appraisal of all types of real estate.  Two members are members-at-large and the other three members represent three statutory districts.  District I is comprised of Pima, Santa Cruz, Cochise, Graham and Greenlee counties; District II includes Maricopa, Yuma, La Paz, Pinal and Gila counties; and District III consists of Mohave, Yavapai, Coconino, Apache and Navajo counties.  No more than three members may be of the same political party (A.R.S § 37-213).

SALARY OR OTHER COMPENSATION:

Members are eligible to receive compensation of up to thirty dollars for each day engaged in the service of the Board.
