AN ACT

 

amending sections 15‑1467 and 15‑1725, Arizona Revised Statutes; relating to budget reconciliation for higher education.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Section 15-1467, Arizona Revised Statutes, is amended to read:

START_STATUTE15-1467.  State aid appropriations; disbursement procedure; district fund

A.  Appropriations for state aid to districts shall be distributed to each community college district in accordance with section 15‑1466.

B.  On July 15, October 15, January 15 and April 15, each district shall present to the department of administration a claim for one‑fourth of the annual amount appropriated to the district.  The department of administration shall draw a warrant in payment of the claim and transmit the warrant to The state treasurer who shall disburse one‑fourth of the annual amount of the funds monies to each district in the first month of each quarter for the support and maintenance of the district, to be expended as provided by law.  If no community college exists, the department shall establish a fund for new future districts to be disbursed as needed.

C.  Notwithstanding subsection B of this section, a district may request the state treasurer to disburse the monies to the local government investment pool for deposit into the district's account as established in section 35‑326. END_STATUTE

Sec. 2.  Section 15-1725, Arizona Revised Statutes, is amended to read:

START_STATUTE15-1725.  Medical student loan fund

A.  The medical student loan fund is established.  The department of health services shall administer the fund.  All monies appropriated to carry out sections 15‑1723 and 15‑1724 shall be deposited in the fund, and All payments of principal and interest received by the board shall be deposited, pursuant to sections 35‑146 and 35‑147, in the fund.  Monies in the fund are continuously appropriated for use by the board for the purposes prescribed in section 36‑2172.

B.  Monies in the medical student loan fund are exempt from the provisions of section 35‑190 relating to lapsing of appropriations. END_STATUTE

Sec. 3.  Community colleges; capital outlay aid; suspension

Notwithstanding section 15‑1464, Arizona Revised Statutes, or any other law, capital outlay state aid for community colleges is suspended for fiscal year 2012‑2013.

Sec. 4.  Community colleges; capital aid funding for fiscal year 2012-2013; uses

Notwithstanding section 15‑1464, subsection G, Arizona Revised Statutes, for fiscal year 2012‑2013, each community college district may use any portion of its capital outlay funding for operating aid expenses.

Sec. 5.  Financial aid trust fund; required state match

Notwithstanding section 15-1642, subsection C, Arizona Revised Statutes, for fiscal year 2012-2013, each dollar raised pursuant to the surcharge on student registration assessed pursuant to section 15-1642, subsection A, Arizona Revised Statues, may be matched by less than two dollars appropriated by the legislature.
