AN ACT
prescribing application of certain ignition interlock requirements.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Ignition interlock deferrals; requirements; exception
A. Notwithstanding any other law, any person who violates section 28‑1381, Arizona Revised Statutes, before January 1, 2012, who is sentenced pursuant to section 28-1381, subsection I, Arizona Revised Statutes, and who is required to equip any motor vehicle the person operates with a functioning certified ignition interlock device pursuant to section 28-3319, subsection D, paragraph 1, subdivision (a), Arizona Revised Statutes, is eligible for deferral of the remainder of the person's ignition interlock period pursuant to section 28-3319, subsection H, Arizona Revised Statutes, if all of the requirements prescribed in section 28-3319, subsection H, Arizona Revised Statutes, are satisfied.
B. Notwithstanding any other law, any person who violates section 28‑1381, subsection A, Arizona Revised Statutes, before or after January 1, 2012, is eligible for removal of the ignition interlock requirement pursuant to section 28-3319, subsection G, Arizona Revised Statutes, if all of the requirements prescribed in section 28-3319, subsection G, Arizona Revised Statutes, are satisfied.
C. Subsection A of this section does not apply to holders of commercial driver licenses.
Sec. 2. Emergency
This act is an emergency measure that is necessary to preserve the public peace, health or safety and is operative immediately as provided by law.
