A CONCURRENT RESOLUTION

 

Proposing an amendment to the Constitution of Arizona; amending article IV, part 1, Constitution of Arizona, by adding section 3; relating to voter‑protected funding.

Be it resolved by the House of Representatives of the State of Arizona, the Senate concurring:

1.  Article IV, part 1, Constitution of Arizona, is proposed to be amended by adding section 3 as follows if approved by the voters and on proclamation of the Governor:

3.  Voter-protected funding; temporary suspension

A.  Notwithstanding section 1, subsection (6)(C), (6)(D) or (14) of this part of this article, for fiscal years 2010‑2011, 2011-2012, 2012-2013 and 2013-2014, by majority vote, the legislature may:

1.  Appropriate or divert not more than fifty per cent of any fund revenue or fund balance created or allocated to a specific purpose by any measure.

2.  Amend or supersede a measure that requires an expenditure of state revenues.

3.  Amend or supersede a measure in order to implement this section.

B.  Monies appropriated or diverted pursuant to this section shall be separately segregated by source and shall be appropriated by the legislature for purposes similar to those allowed in the measure authorizing the collection of the monies to the extent possible.

C.  Any bill passed by the legislature pursuant to this section shall be effective only until not later than June 30, 2014.

2.  The Secretary of State shall submit this proposition to the voters at the next general election as provided by article XXI, Constitution of Arizona.
