AN ACT

 

establishing the water resources development commission.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Water resources development commission; members; statewide water augmentation authority; report; delayed repeal

A.  The water resources development commission is established consisting of the following members:

1.  One representative of a small domestic water improvement district who is appointed by the speaker of the house of representatives.

2.  One representative of a large domestic water improvement district who is appointed by the president of the senate.

3.  One representative of a water related special taxing district who is appointed by the governor.

4.  One representative of a large private water company who is appointed by the speaker of the house of representatives.

5.  One representative of a small private water company who is appointed by the president of the senate.

6.  One representative of the mining industry who is appointed by the governor.

7.  One representative of the agriculture industry who is appointed by the speaker of the house of representatives.

8.  One representative of a city with a population of two hundred thousand persons or more who is appointed by the president of the senate.

9.  One representative of a city with a population of less than two hundred thousand persons who is appointed by the governor.

10.  Three representatives from counties with a population of less than one hundred seventy thousand persons.  The speaker of the house of representatives, the president of the senate and the governor shall each appoint one of these members.

11.  One representative of an electrical power provider who is appointed by speaker of the house of representatives.

12.  One representative of the homebuilding industry who is appointed by the president of the senate.

13.  One person who has experience in a water related field and who is appointed by the governor.

B.  The commission shall consider and assess:

1.  The projected water needs in each county in the next fifty and one hundred years.

2.  The projected water storage and delivery obligations of the central Arizona project, the central Arizona groundwater replenishment district, the Salt River project and the Arizona water banking authority.

C.  The commission shall develop recommendations, including recommended legislation, regarding:

1.  The development of future water acquisitions, including financing mechanisms for acquiring those supplies.

2.  The development of infrastructure necessary for the delivery of future water acquisitions, including financing mechanisms.

3.  The development of a statewide water augmentation authority for the purpose of identifying new sources of water in this state and in the lower Colorado river basin for future municipal and industrial use, facilitating the acquisition of sources of water for industrial and municipal use and assisting in developing infrastructure for the storage and delivery of water supplies.  The commission may consider and make recommendations regarding modifications to any existing agency or authority to accomplish some or all of the statewide water augmentation authority's duties.

D.  The commission shall consult with the department of water resources regarding a technical advisory committee for the commission.

E.  The commission shall prepare a report of its findings and recommendations, including recommendations for suggested legislation, and submit it to the governor, the speaker of the house of representatives and the president of the senate, on or before December 15, 2010.  The commission shall provide a copy of this report to the secretary of state.

F.  This section is repealed from and after September 30, 2011.
