AN ACT

 

amending title 13, chapter 37, Arizona Revised Statutes, by adding section 13-3728; relating to false compartments in motor vehicles.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 13, chapter 37, Arizona Revised Statutes, is amended by adding section 13-3728, to read:

START_STATUTE13-3728.  Unlawful use, ownership or installation of a false compartment in a motor vehicle; vehicle seizure; classification; definition

A.  It is unlawful for a person to knowingly own or operate a motor vehicle that contains a false or secret compartment.

B.  It is unlawful for a person to knowingly install, create, build or fabricate a false or secret compartment in a motor vehicle.

C.  A motor vehicle that is used in violation of this section is subject to seizure and forfeiture pursuant to chapter 39 of this title.

D.  A violation of this section is a class 5 felony.

E.  For the purposes of this section, "false or secret compartment" means any enclosure that is integrated into or attached to a motor vehicle and that is intended and designed to be used to conceal, hide or prevent discovery by law enforcement officers of the enclosure or its contents.  END_STATUTE
