AN ACT

 

Amending title 36, chapter 20, article 1, Arizona Revised Statutes, by adding section 36-2153; relating to abortion.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 36, chapter 20, article 1, Arizona Revised Statutes, is amended by adding section 36-2153, to read:

START_STATUTE36-2153.  Performance of abortion by nurse; prohibition; definition

A.  Notwithstanding any other law, a nurse who is licensed pursuant to title 32, chapter 15 is prohibited from performing a surgical abortion.

B.  For the purposes of this section, "surgical abortion" means the use of a surgical instrument or a machine with the intent to terminate a woman's pregnancy for reasons other than to increase the probability of a live birth, to preserve the life or health of the child after a live birth, to terminate an ectopic pregnancy or to remove a dead fetus.  Surgical abortion does not include patient care incidental to the procedure.
