SUBJECT:      House Changes to S.B. 1211 – industrial development bonds; review exception. (NOW: project review; coordination; cooperation)

            As passed by the Senate, S.B. 1211 allows any state agency or an industrial development authority (IDA) involved in the review of bond issuances to cooperate in the review of a project if it is for a nonprofit nursing home, rest home, skilled nursing facility or life care facility.  Additionally, it allows one or more agencies to enter into an intergovernmental agreement for the purpose of consolidating the review and allows an agency, to the extent practicable, to schedule its review in a manner that minimizes the overall review time of the project.  S.B. 1211 repeals the multiple review provisions on January 1, 2011.

 

            The House of Representatives adopted a strike everything amendment to S.B. 1211 regarding the same subject with the following changes:

 

1.      Allows an IDA and the governing bodies approving the formation of an IDA, the Arizona Department of Housing, the Arizona Health Facilities Authority or the Arizona Department of Insurance to cooperate in the review only, instead of all state agencies. 

 

2.      Removes the specific provisions regarding the use of intergovernmental agreements and scheduling to minimize review time and states generally that the reviewing entities may agree to share information, coordinate review schedules or jointly conduct reviews. 

 

3.      Changes the multiple review provisions repeal date from January 1, 2011, to January 1, 2010.

 

4.      Makes the provisions session law instead of statutory law.
