SUBJECT: House Changes to S.B. 1006 – deferred presentment; military service members

As passed by the Senate, S.B. 1006 establishes requirements for providing payday lending services to members of the military or their spouses by deferred presentment companies (licensee).
S.B. 1006 as passed by the Senate, prohibits the licensee from contacting the employer of a military member about a deferred presentment debt of the member or the member’s spouse. The House of Representatives amended S.B. 1006 to require the licensee to contact the employer of a military member about the deferred presentment debt of the member or the member’s spouse and stipulates this contact is for informational purposes only and the licensee cannot attempt to collect on a loan through the member’s chain of command. The House of Representatives also amended the bill by prohibiting military members or their spouses from being able to rollover a payday loan.
