SB 1322, as printed, establishes that glass repair facilities are considered to be the same as repair facilities for the purpose of the insured’s right to choose due to a loss or claim.

 

The Committee on Commerce adopted a strike-everything amendment that expands the definition of Domestic Microbrewery, changes limitations for production and places restrictions on the sale to other retailers.  

 

History

An Arizona licensed Domestic Microbrewery may sell beer produced/manufactured on its premises to be consumed either on or off-site and may make sales and deliveries of beer to both retailers and wholesalers who are properly licensed by the Arizona Department of Liquor Licenses and Control (DLLC).  Further, the Domestic Microbrewery may serve samples of beer. 

 

Following the first year, annual production must equal at least 10,000 gallons, limited to 310,000 gallons per year. Any retail operations must be conducted at the site of the microbrewery, which may sell other spirituous liquor if the business has an on-sale retail license and the liquor sales are on or adjacent to the microbrewery.  Any person with a Domestic Microbrewery license may also possess other on-sale retail licenses if the person is not otherwise a vintner, distiller, brewer or other producer of spirituous liquor; however, the person must purchase all spirituous liquor to be sold at the other on-sale retail premises from licensed Arizona wholesalers.

 

Provisions

·          Separates the domestic microbrewery statutes from the domestic farm winery statutes.

·          Defines Domestic Microbrewery to include any brewery in the United States, or its territory or possession that meets the statutory requirements.

·          Requires the Annual Report to DLLC to include the amount of beer delivered as well as the current requirement to include the amount manufactured.

·          Outlines the beer production limitations as follows: not less than 5,000 gallons in each calendar year following the first year in operation, nor more than 620,000 gallons per calendar year thereafter (now 10,000 to 310,000 gallons). 

·          Limits the amount of beer a Microbrewery may sell to other licensed retailers to 93,000 gallons in any calendar year.  Any excess must be purchased from a wholesaler.

·          Permits a Domestic Microbrewery to sell and deliver beer to licensees in other states, provided the sale or delivery is also lawful in the other states.

·          Conforms Department of Revenue statutes for purposes of taxation.
