SB 1322 establishes that glass repair facilities are considered to be the same as repair facilities for the purpose of the insured’s right to choose due to a loss or claim.

 

History

Arizona Revised Statute (ARS) §20-468 added by Laws 2004, Chapter 233 §2, excludes glass repair facilities from the list of available choices for the repair of a motor vehicle loss. Currently there are separate statutes that pertain to the repair of a motor vehicle loss for glass repair facilities and other losses.

 

ARS §20-469 added by Laws 2004, Chapter 226, §3, gives a person the right to choose any glass repair facility for the repair of a loss relating to motor vehicle glass. If an insurer recommends or provides information about a glass repair facility, the insurer shall inform the person of this right at the same time as making the recommendation or providing the information. This does not create a private right or cause of action to or on behalf of any person and provides solely an administrative remedy to the director for any violation. 

 

Provisions

·          Establishes that glass repair facilities are considered to be the same as repair facilities for the purpose of the insured’s right to choose due to a loss or claim.

 

·          Repeals ARS §20-469, which states that a person in this state has the right to choose any glass repair facility for the repair of a loss relating to motor vehicle glass.

 

·          Makes technical and conforming changes.
