HB2707 creates restrictions on prescription availability for minors.

History

Currently, there is no law requiring that parents or guardians give written consent in order for a minor to be prescribed medication.

The physical presence of a parent or legal guardian when a minor receives a tattoo or body piercing, with the exception of ear piercing, which requires either written or verbal permission of a parent or guardian.

However, Arizona statutes require written consent from a minor’s parent or guardian for the following procedures:

· Conducting genetic tests of minors.

· Testing a minor for sickle cell anemia.

· Performing an abortion on a minor.

· Performing a surgery on a minor.

· Performing tattoos or piercings on a minor, with the exception of ear piercing.

Certain exceptions to the laws may apply, such as surgery necessary to save the life of a minor if the parent cannot be located after a reasonable effort.

Provisions

· States that a physician may not issue a prescription to a minor without the expressed written consent of the minor’s parents or legal guardians.

· Maintains that a physical who does not follow these new guidelines be guilty of unprofessional conduct.
