HB 2556 removes the requirement that any monies in excess of $150,000 in the Motorcycle Safety Fund (MSF) revert to the State Highway Fund.
History
ARS section 28-2010 provides for a Motorcycle Safety Fund (MSF) that receives one dollar of every motorcycle registration collected by the Arizona Department of Transportation Motor Vehicle Division (MVD). The fund is used to implement and support voluntary motorcycle education, awareness and other programs, including covering the cost of materials for motorcycle safety, education and awareness programs. The fund is administered by the Governor’s Office of Highway Safety (GOHS).
Currently, the fund is capped at $150,000 and is subject to legislative appropriation. All deposits in excess of this amount revert to the State Highway Fund. In 2003, the MSF exceeded its cap and reverted $10,100 to the State Highway Fund. According to the Joint Legislative Budget Committee (JLBC), this was the only year a reversion occurred. The MSF is projected to grow as Arizona’s population increases and more motorcycles are registered.
