HB 2307 requires all homeowner associations to provide specific materials to the purchaser of a unit within 10 days of receipt of a notice of pending sale.

History

A.R.S. Title 13, Chapter 32 outlines several offenses involving prostitution and provides corresponding penalties.  Under this chapter, prostitution is defined as “engaging in or agreeing or offering to engage in sexual conduct with another person under a fee arrangement with that person or any other person.

 

A.R.S. § 13-3214 makes knowingly engaging in prostitution a Class 1 misdemeanor.  A Class 1 misdemeanor is punishable by up to 6 months in jail and a fine of up to $2,500 plus surcharges.

 

Provisions

·           Provides the following minimum jail penalties for prostitution:

­       15 consecutive days in jail for a 1st offense

­       30 consecutive days in jail for a 2nd offense

­       60 consecutive days in jail for a 3rd offense

­       180 consecutive days in jail for a 4th or subsequent offense

 

·          States that a person is not eligible for probation or suspension of the sentence unless the entire sentence is served.

 

·          Makes a fourth or subsequent prostitution violation a Class 5 felony.

 

·          Allows cities and towns to enact/enforce prostitution ordinances that provide a punishment (for misdemeanors) that is at least as stringent as provided in law.

 

·          Makes a previous prostitution violation under a city/town ordinance a previous violation under the terms of this statute for sentencing purposes, if the ordinance has the same or substantially similar elements.

 

·          Makes technical and conforming changes.
