HB 2076 expands the list of places a weapon may be stored in a vehicle without a permit to carry a concealed weapon and requires an operator of a public event to have a secure and temporary place to store weapons which are in custody at the event.
A.R.S § 13-3102 obligates a person to place a weapon in the custody of the operator of a public event or public establishment if a reasonable request by the operator of the event or establishment has been made.
A.R.S. § 13-3102 allows a person to carry a weapon in a vehicle without a permit to carry a concealed weapon (CCW) if it is in a case, holster, scabbard, pack or luggage that is carried within a vehicle or a storage compartment, trunk or glove compartment of a vehicle.
According to the Fiscal Note prepared by JLBC, the bill would have a state cost to the extent that storage facilities would be added to state buildings. However, the magnitude of the fiscal impact cannot be determined as a list of current security arrangements in state buildings is not available. State buildings are grouped into three building systems, the Arizona Department of Transportation (ADOT), the Arizona Department of Administration (ADOA), and the Universities. ADOT estimates a one time cost of $90,000 and an ongoing security cost of $4 million. ADOA and the Universities have not provided a cost estimate of the bill.
· Creates a new section requiring temporary and secure storage of a weapon that an operator of a public event/establishment has in custody.
- The storage must be readily accessible upon entrance and exit of the event/establishment.
· Allows a person to carry a weapon in a vehicle concealed without a CCW if the weapon is stored in a map pocket.
· Exempts public establishments or public events with a liquor license from being required to have a storage place for weapons.
· States that an operator of an establishment or the sponsor of the event is not liable for acts or omissions unless the person intended to cause injury or was grossly negligent.
· Makes a technical change.
