SENATE BILL 1158

 

 

 

AN ACT

 

making an appropriation to the arizona criminal justice commission for local enforcement of illegal immigration.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Appropriation; illegal immigration; enforcement; exemption

A.  The sum of $75,000,000 is appropriated from the state general fund in fiscal year 2006-2007 to the Arizona criminal justice commission to award grants to county sheriffs and other local law enforcement or state agencies that operate in counties along Arizona's border with Mexico to apprehend persons who are in this state illegally and who are in possession of any of the following:

1.  A dangerous drug as defined in section 13-3401, Arizona Revised Statutes.

2.  Precursor chemicals that are used in the manufacturing of methamphetamine in violation of section 13-3404.01, Arizona Revised Statutes.

3.  A deadly weapon as defined in section 13-3101, Arizona Revised Statutes, or a dangerous instrument as defined in section 13-105, Arizona Revised Statutes.

4.  Property that is used for the purpose of committing an act of terrorism as prescribed in section 13-2308.01, Arizona Revised Statutes.

B.  The total amount of grant monies awarded to all agencies shall not exceed $15,000,000 in any fiscal year.

C.  Grants may be awarded to employ additional officers, equipment, judges, prosecutors, public defenders and support personnel to further the purposes of this section.

D.  Recipients of monies from the appropriation made in subsection A of this section shall not use the monies to supplant existing or future monies received for these or other maintenance of effort purposes but shall use the appropriated monies as additional resources to deter illegal immigration.

E.  The appropriation made in subsection A of this section is exempt from the provisions of section 35-190, Arizona Revised Statutes, relating to lapsing of appropriations.
