HOUSE OF REPRESENTATIVES AMENDMENTS TO S.B. 1210

Strike everything after the enacting clause and insert:
"Section 1. Dental services pilot program for persons with developmental disabilities; report; definitions
A. The dental services pilot program for persons with developmental disabilities is established. The department of economic security shall administer the pilot program. The department of economic security shall consult with the department of health services to ensure that dental services are provided in a cost-effective and timely manner.
B. The pilot program shall:
1. Be located in a county with a population of more than one million, five hundred thousand persons.
2. Select as the service provider a dental school that is equipped to provide dental services to persons with developmental disabilities.
3. Begin not later than October 1, 2006 and end December 31, 2007.
4. Provide dental services to persons with developmental disabilities who are at or below two hundred fifty per cent of the federal poverty guidelines.
5. Restrict each program participant to not more than ten thousand dollars in dental services.
6. Require the service provider to make all efforts to use composite materials and to use mercury amalgam only as a last resort.
7. Provide transportation to program participants to the service provider.
C. The department of economic security shall adopt rules to prescribe the application and eligibility requirements for program participants. The rules must provide for an expedited process to enroll program participants and to begin providing dental services.
D. The department of economic security shall submit a report on the pilot program to the governor, the president of the senate and the speaker of the house of representatives on or before February 1, 2008. The department shall provide a copy of this report to the secretary of state and the director of the Arizona state library, archives and public records. The report shall include:
1. The number of program participants categorized by disability.
2. The type and number of dental services provided to program participants, including any services necessary to prepare the program participant for dental care.
3. Transportation provided to program participants to the service provider categorized by:
(a) The number of trips by each program participant.
(b) The type of transportation provided.
(c) The distance traveled.
(d) Where each trip originated.
4. The cost of dental services provided to each program participant and a comparison to the cost of the same service provided in a private practice setting.
5. The number of times that mercury amalgam was used and the reasons why the dental provider was unable to use composite materials.
6. The number of dental students who were trained to provide dental services to program participants.
7. The services provided to program participants that emphasized preventive care techniques.
E. The report required by this section shall not personally identify any program participant.
F. For the purposes of this section:
1. "Dental services" includes preventive dental care, restoration, anesthesia and emergency dental services.
2. "Persons with developmental disabilities" means adults who are qualified to receive services pursuant to title 36, chapter 5.1, Arizona Revised Statutes, but who are not eligible to receive dental services pursuant to title XIX of the social security act.
Sec. 2. Exemption from rule making
For the purposes of this act, the department of economic security is exempt from the rule making requirements of title 41, chapter 6, Arizona Revised Statutes, for one year after the effective date of this act.
Sec. 3. Appropriation; purposes; exemption
A. The sum of $1,000,000 is appropriated from the state general fund in fiscal year 2006-2007 to the department of economic security for the purposes of this act. Of this amount:
1. The sum of $925,000 is appropriated for dental services.
2. The sum of $75,000 is appropriated for transportation services.
B. The department shall not use appropriated monies for administrative or any other purpose.
C. The appropriation made in subsection A of this section is exempt from the provisions of section 35-190, Arizona Revised Statutes, relating to lapsing of appropriations.
Sec. 4. Delayed repeal
This act is repealed from and after September 30, 2008."
