FACT SHEET FOR H.B. 2248

inoperative traffic control signals


Purpose

Requires drivers to make a complete stop and yield to the driver of the vehicle to the right when approaching an inoperative traffic signal.

Background

Currently, there are no state laws governing the movement of traffic in cases where the traffic lights become inoperable. In the past, there have been instances when a power outage has left traffic signals totally inoperable, which has led to confusion regarding which motorist has the right-of-way at a signalized intersection. Under H.B. 2248, if traffic signals become inoperable, an affected intersection would become a four-way stop and motorists would have to follow the A right-hand rule @ when crossing the intersection.

There is no known or anticipated fiscal impacts to the state or local jurisdictions as a result of this legislation.

Provisions

1. Requires drivers, when approaching an inoperative traffic signal, to make a complete stop and proceed with caution when it is safe to do so.


2. Specifies that if two or more vehicles approach an inoperative traffic signal from different streets or highways at the same time, then the drivers must make a complete stop and the driver of the vehicle on the right has the right-of-way.


3. Contains a general effective date.
