Chairman Smith called the meeting to order at 1:40 p.m. and attendance was taken.

 

Approval of Minutes

 

Chairman Tom Smith moved the minutes of June 15, 2007 be approved. Without objection, the minutes were approved as distributed.

 

Approval of changes to inscription on the State’s Enduring Freedom Memorial

 

Tom Smith reviewed the recommended changes to be made to the Enduring Freedom Memorial (Attachment A).

 

Thomas Chapman moved that the Commission approve the changes recommended for the Enduring Freedom Memorial. The motion carried by voice vote.

 

Presentation and possible approval of work group recommendations

 

Mr. Smith gave an overview of the concerns regarding the 9/11 Memorial in the Wesley Bolin Governmental Mall.

 

William Bell expressed concern about the Commission’s statement that phrases appearing on the 9/11 Memorial were not presented and approved by the Commission first. He also noted that the recommendations presented to the Commission were required, by statute, to be done so by the proponents. He told the Commission that he saw nothing in legislation allowing the Commission to retroactively alter any prior agreements made with the 9/11 Commission.

 

Mr. Chapman gave an overview of the charge given to the Commission.

 

Representative Kavanagh suggested that the Commission make recommendations now, and then discuss the language of the Commission’s charge at a later time.

 

Mr. Bell stated that the Commission had no basis to currently make a recommendation.

 

Bill Boyd, Senate Special Projects Coordinator, read the recommendations made by the Legislative Governmental Mall Commission work group relating to changes to be made to the memorial.

 

Billy Shields, 9/11 Commission, Chairman, updated the members on progress made by the 9/11 Commission, and submitted a handout detailing this progress (Attachment B). He stated that the recommendations presented by him today were from the 9/11 Commission.

 

Mr. Smith moved that the Commission vote on the recommendations put forth by the 9/11 Commission.

 

Mr. Chapman moved the Commission table the discussion until another meeting and the attorneys have an opportunity to review the information.

 

Representative Kavanagh suggested they hear from the Commission’s attorney as to what action might be appropriate at the current time.

 

Jim Drake, House Rules Attorney, remarked that he was not the Governmental Mall Commission’s attorney and that it would be improper to render any legal advice to the Commission.

 

Mr. Smith moved the Commission table the recommendations of the work group. The motion carried by a vote of 5-1-4 (Attachment C).

 

Mr. Smith requested that the statements of Billie Kozolchyk be placed in the records (Attachment D).

 

 

 

 

There being no further business, the meeting was adjourned at 2:35 p.m.
